RMI Newsflash – Unprotected protest action on Friday 03 November 2023

RMI Newsflash – Unprotected protest action on Friday 03 November 2023 regarding the public transport system

2 November 2023

Dear Valued Member,

The Congress of South African Trade Unions (Cosatu), Federation of Unions of South Africa (Fedusa) and National Council of Trade sent an application to NEDLAC on 24 July 2020 under Section 77 (1) (b) of the Labour Relations Act 66 of 1995. (‘the LRA’).

This application set out concerns regarding the inadequacies of the public transport system and called for a safe, reliable, and affordable system.

Against this background, a strike was scheduled to take place on Friday, 03 November 2023.

In response to the application, however, the NEDLAC Steering Committee has indicated that the anticipated strike fell short of the requirements of Section 77(1)(c) and (d) of the LRA because:-

The 14 – day notice period was not issued.
The Standing Committee had not considered the privatization issue.

Any strike- or protest action in this regard will therefore be unprotected.

The unprotected protest action has the following implications in respect of unauthorised absence on the day:-

– It may result in disciplinary action, that may include dismissal.
– It will be unpaid.

If you have any queries in this regard, please contact your local IR Specialist:  IR Contacts – Retail Motor Industry Organisation (rmi.org.za)

Regards,
Jeff Molefe
Director: Labour
